The Notre Dame Archives charges a service fee to cover the initial cost of providing copies of material from our collections. Any subsequent use or redistribution of this material is subject to an additional duplication fee. The duplication fee is not a licensing or copyright fee. Applicants should be aware that physical ownership by the Notre Dame Archives does not imply that Notre Dame has ownership of copyright to the materials and the request for the payment of a duplication fee does not constitute a claim of copyright by Notre Dame or imply that you have permission of the copyright owner to use the materials in a commercial venture. Obtaining a license from the copyright owner and payment of licensing fees are the user's responsibility.

CONDITIONS




1. Copyright

a. All responsibility for possible copyright infringement and invasion of privacy arising from use of reproductions from the collections of the Notre Dame Archives is assumed by the user. The user agrees to indemnify and hold harmless the University of Notre Dame ("Notre Dame"), its officers, trustees, employees and agents from and against any and all claims, damages or liability (including attorney's fees) that Notre Dame, its officers, trustees, employees and agents may incur as a result of or in any way related to the use or redistribution of the reproduction.

b. Completion of this form, including a counter signature by a representative of the Notre Dame Archives, gives the user Notre Dame's permission to duplicate whatever material was provided by the Notre Dame Archives for which the University holds rights, title, or interest. This permission, however, extends only so far as our rights, and is rendered with the reminder that the user has agreed to accept sole responsibility for the infringement of any other rights which are not the property of the University of Notre Dame as as well being solely responsible for the manner in which the material is used. The user should understand that the copyright status of many works held by the Archives is uncertain.

2. Permission for duplication is granted only for the expressed purpose described in this application and is contingent upon receipt of any and all other necessary permissions which are the sole responsibility of the user. Permission is non-exclusive and non-transferable and is for one-time use only with no other rights unless those rights are specifically described on this form.

3. All copies provided by the Notre Dame Archives, for other than personal use, remain the property of the Archives and must be returned upon completion of the project. Unless otherwise stated, the user is not allowed to retain any copies made from material provided by the Notre Dame Archives.

4. Any permissions granted to the user are contingent upon payment of all fees. Default in payment shall immediately revoke permission. The Notre Dame Archives reserves the right to adjust service and duplication fees according to the nature and scope of the project.

5. All uses of copies from the Archives must include the name of the Notre Dame Archives in a caption or credit. The applicant agrees to provide the Notre Dame Archives with one copy of any work containing a reproduction of any image or textual copy provided to the applicant.
